The City of Ontario's historic preservation ordinance specifically
allows a designated Single Family residence to retain its single car
garage and not provide the additional enclosed parking space when a
substantial addition is proposed if the single car garage is historic
and is either in good repair or the applicant has included restoration
of the garage in the project scope of work. In this case it is not a
variance from the standard since the standard has been modified and is
explicitly described. Also, our code allows for deviation from parking
standards in historic downtown based on a downtown parking model and
where on-street parking and public parking lots are available.
We are looking into modifying the Legal Non Conforming provisions to
allow greater flexibility on setbacks for additions if it would help the
addition work better with the existing house.
While during my time here we have not processed a variance request for a
historic property, I can imagine allowing it if the variance would in
some way protect the resource in which case I think the variance
findings could probably be made (unique circumstances, etc.). But, I
don't see this happening very often.

Hi Lucinda, my name is Ann McCaull and I manage Coronado's Historic
Preservation Program. Our Historic Preservation Ordinance has been in
effect for 8 years and we offer zoning exceptions through the Historic
Alteration permit process that are reviewed by the Historic Resource
Commission. Due to some pending litigation, our attorneys are
questioning the legality of HRC's ability to waive zoning e.g. setbacks,
heights, etc. I know other cities have these types of ordinances and am
trying to give examples to our attorney (for cities that are not Charter
cities).
I thought I would check with your office and see if you have any records
of how many cities in California have historic preservation ordinances
that offer zoning incentives such as exceptions to zoning regulations
that are provided to historic resources as incentives. Or, maybe you
know of some cities that do?
Any assistance/input you could provide would be helpful.
