Good Morning CLGs! On Monday the 23rd, CPF will be holding a workshop
in San Clemente on the Mills Act and we would like to share what's
happening in other communities with the Mills Act program. Please share
what's going on in your community when you have a minute.
*SOUNDS GREAT, GOOD LUCK ON YOUR WORKSHOP!
1. How old is your program?
*16 YEARS OLD
2. Eligibility: Are all listed buildings eligible for Mills Act
*DESIGNATED HISTORIC LANDMARKS AND CONTRIBUTING STRUCTURES TO DESIGNATED
HISTORIC DISTRICTS
3. Additions: Do you allow additions to historic structures under
the Mills Act if they follow the standards? *YES What size additions do
communities allow under the contract? *AS GENERAL CRITERIA, SUCH
ADDITIONS SHOULD NOT DISTRACT AWAY FROM THE CHARACTER OF THE RESOURCE,
ANOTHER KEY REQUIREMENT IS COMPATIBILITY TO THE SECRETARY'S STANDARDS.
Are they assessed under the special assessment? *ADDITIONS TO MILLS ACT
CONTRACT PROPERTIES ARE ASSESSED AT AN "UNADJUSTED" RATE.
4. Restoration Conditions: What type of improvements do
communities require within the 10 years, if any? *IT DEPENDS ON THE
CONDITION OF THE ELIGIBLE PROPERTY AT THE TIME OF CONTRACT APPROVAL; AS
A KEY HISTORIC PRESERVATION INCENTIVE, THIS PROGRAM IS PROMOTED BY RWC
IN ORDER TO ASSIST IN THE FINANCING OF THE (APPROPRIATE) MAINTENANCE OF
THE SUBJECT RESOURCE OBVER THE LONG TERM. Do you add more after the
initial 10 years? *YES TYPICALLY, BUT IT DEPENDS ON THE CONDITION OF THE
PROPERTY What other restrictions/clauses does your community require?
*PREVENTIVE RESTRICTIONS ARE PURPOSEFULLY INCORPORATED TO MILLS ACT
CONTRACTS RELATING TO THE PROPER MAINTENANCE OF THE EXTERIOR APPEARANCE
OF THE PROPERTY (I.E. NO STRORAGE OF SALVAGE MATERIALS, INOPERABLE
VEHICLES ETC...)
5. Monitoring: How does your community track their contracts and
the improvements? *YEARLY
6. City Revenue Loss: Does your community maintain an assessment
tracker to understand the amount of city revenue "lost" every year due
to the special tax assessment? *EVERY TIME THE CITY COUNCIL APPROVES A
NEW MILLS ACT CONTRACT, THE STAFF REPORT GENERALY INCLUDES A "FISCAL
IMPACT" SECTION WHICH EXPLAINS THE LOSS OF REVENUE, BOTH SPECIFIC AND
CUMULATIVE.
7. Lessons Learned/Recent Issues..
*THE PROPERTY TAX DOES NOT SEEM TO BENEFIT PROPERTIES ASSESSED BELOW
$300k (OR THEREABOUTS)
*BE CLEAR ABOUT THE PROGRAM EARLY ON, TAX BENEFITS VARY FROM YEAR TO
YEAR SOME PROPERTY IT IS A 40% SAVINGS, OTHERS ARE 60%.
*BE FLEXIBLE, THIS IS ALSO ABOUT ENHANCING COMMUNITY PRIDE
